Terms of Service

The agreement between you and WaiverSaver for using the service. Short on purpose; the Privacy Policy and Data Processing Agreement cover data in detail.

1. The service

WaiverSaver lets an organization publish documents — permission forms, waivers, acknowledgments — and collect electronic signatures on them from parents, guardians, and participants, with a record of who signed what and when. It is operated by WaiverSaver, operated by Yonah Create.

2. Your account

The person who creates an account represents that they are authorized to act for the organization. You are responsible for who you add to your team and for removing people who should no longer have access. Keep your admin key private; treat it as a password.

3. Your documents are yours — and your responsibility

You write or upload the documents you ask people to sign. We do not supply waiver or consent language, and nothing in the service is legal advice. Whether any clause in your documents is enforceable is a question for your own counsel; we remind you once a year, before your season begins, to have them reviewed.

4. What we prove, and what we don't

For every signature we record the exact documents shown, a cryptographic fingerprint of each, the signature, the signer's name and stated relationship, the time, and the network address — and we give the signer a certificate of it. That is evidence of informed consent. We do not promise that any particular document will have any particular legal effect.

5. Acceptable use

Use the service only to collect signatures from people who have a genuine relationship with your organization and its events. Do not upload content you have no right to use, collect information you do not need, attempt to access another organization's data, or use the service for anything unlawful. We may suspend an account that does.

6. Data

Our Privacy Policy describes what we collect and why. Our Data Processing Agreement, accepted when your account is created, governs student and family data and designates us as your school official where FERPA applies. Signed records are kept permanently unless you direct otherwise.

7. Availability and changes

We aim to keep the service available at all times but do not guarantee it. We may improve or change the service; if a change materially reduces what you rely on, we will tell you first. If we ever end the service, we will give you at least 90 days' notice and a way to export everything.

8. Fees

The service is currently provided without charge. If we introduce fees, they will apply only after you have agreed to them.

9. Limits on our liability

To the fullest extent the law allows, WaiverSaver is not liable for indirect or consequential losses, or for any loss arising from the content of your own documents or from a signer's statements. Where liability cannot be excluded, it is limited to the fees you paid us in the twelve months before the claim, or $100 if you paid none. Nothing here limits liability that cannot be limited by law.

10. Ending the agreement

You can close your account at any time by asking us. We can end it on notice if you breach these terms. Either way, Section 8 of the Data Processing Agreement governs what happens to signed records.

11. Governing law

Georgia law governs these terms. Accepting them electronically has the same effect as signing on paper under Georgia's Uniform Electronic Transactions Act and the federal ESIGN Act.
